The Dangers of Medical Negligence: Sobering Facts and Figures

Medical malpractice is more common than you think. Numerous reports in recent years have uncovered some alarming numbers:

roses

Fatal Medical Errors

According to a 2016 study by Johns Hopkins, medical negligence causes more than 250,000 deaths in the United States each year. To put that in perspective, that means seven times more people die annually from medical negligence than from auto accidents.

A Leading Cause of Death

These high numbers mean that 10 percent of deaths each year are due to medical errors. Medical malpractice is the third leading cause of death in America, behind heart disease and cancer. Medical errors can be factors in deaths related to both of those conditions.

5 Most Common Mistakes

A 2015 piece in U.S. News & World Report listed the five main causes of fatal medical mistakes: medication errors, too many blood transfusions, excessive oxygen for premature babies, healthcare-related infections, and infections from IVs and central lines.

The Repercussions of Medical Malpractice: Long-Term Effects and Consequences

Medical malpractice is a special type of personal injury that can result in:

A Need for Additional Medical Care

When a doctor fails to diagnose or treat a problem, additional medical care is usually required in order to correct that error. This can lead to major financial strain and require long periods of recovery.

The Disruption of Your Life

Medical errors and subsequent treatment can interrupt the course of your life. Career and educational setbacks are common as victims deal with illness and related challenges.

Permanent Disability or Impairment

Failure to treat medical problems as soon as they arise could result in lasting disability and impairment. This includes the loss of a limb, limited mobility, paralysis, and diminished cognitive function.

The Loss of a Loved One

Medical malpractice such as a delayed cancer diagnosis, a pharmaceutical contraindication, or a surgical error could mean the loss of a loved one.

Types of Medical Malpractice Cases

Surgical Injury

Negligence on the part of a surgeon, anesthesiologist, or an operating room nurse can have deadly ramifications. Hospital policies pertaining to equipment and staffing can also play a part in surgical errors and malpractice. When representing clients in these types of cases, our medical malpractice lawyers draw upon decades of work to help demonstrate that negligence caused or contributed to a patient's surgical injury or preventable death.

Anesthesia Errors

Mistakes made while administering anesthesia can have serious or fatal consequences. Effects can range from allergic reactions to brain damage and injured internal organs. Both the anesthesiologist and the surgical team must exercise diligence at all times when a patient's life is at stake. If you or a loved one suffered the effects of an anesthesia error, our team can hold the negligent parties responsible.

Misdiagnosis/Failure to Diagnose

A misdiagnosis or failure to diagnose a serious illness can prevent a patient from receiving timely treatment. Doctors are highly trained and trusted to accurately diagnose health concerns, so they must be held responsible for careless inattention. If you or someone you love has suffered as a result of a misdiagnosis or failure to diagnose, our medical malpractice attorneys in Brooklyn are here to provide the legal support you deserve.

Brain Injury

A brain injury can be devastating. In many cases, there are permanent, disabling repercussions that follow brain injury, including personality changes. A brain injury can occur as a result of oxygen deprivation during surgery, errors in pharmaceutical prescriptions, and other medical care mistakes. We offer support for victims and their families, helping them secure compensation for brain injuries caused by medical negligence.

Birth Injury

Birth injuries can be the result of trauma or a medical professional's mistaken diagnosis. These errors can prove catastrophic, causing irreversible brain damage requiring long-term care. Birth injuries such as shoulder dystocia, infection, or a bone fracture may be less serious, but they can still cause pain, emotional trauma, and a need for costly medical treatment. If your child suffered a birth injury, our team can provide legal representation and support.

Cerebral Palsy

Cerebral palsy is a disorder that permanently affects movement and muscle coordination. This devastating condition is often the consequence of oxygen deprivation, head trauma during a difficult birth, or an infection before or after delivery. If your child suffers from cerebral palsy, a medical malpractice attorney at our practice can help determine if it was caused by negligence, and then hold liable parties responsible.

Erb's Palsy

Erb's Palsy is a nerve disorder that causes weakness or paralysis of an arm. This condition often occurs when a baby's shoulder gets caught in the birth canal during delivery. In many cases, medical treatment can fully resolve the injury, but some babies who acquire the condition will continue to experience debilitating symptoms. If your child's case of Erb's Palsy was the result of medical malpractice, our law firm in Brooklyn will fight to secure compensation on your behalf.

Pediatric Malpractice

Parents rely heavily on the care and advice of their child's pediatrician. Unfortunately, when a medical professional is negligent in the diagnosis or treatment of a child's illness, it can have catastrophic consequences. Victims of these medical mistakes may require a lifetime of care. If your child was the victim of pediatric medical malpractice, we will pursue a claim on your family's behalf and hold the liable parties accountable.

Compartment Syndrome

Compartment syndrome is a painful condition caused by bleeding or swelling in a muscle compartment. This is often caused by trauma that creates abnormal pressure in the limbs or abdomen. If not diagnosed and treated, compartment syndrome can lead to nerve damage, muscle damage, and vital organs shutting down. If you suffered compartment syndrome due to improper medical care, we can hold the negligent party responsible for their actions or inaction.

Wrongful Death

The death of a loved one is always a painful event. When a careless doctor or surgeon is to blame, the loss can seem particularly senseless. Our medical malpractice attorneys recognize that no dollar amount will bring back a loved one. However, holding medical professionals responsible and collecting restitution for their negligence can prove helpful when it comes to coping with the loss. A medical malpractice lawsuit can also prevent a similar tragedy from affecting others in the future.

Proving Medical Malpractice: What Lawyers Must Demonstrate

A medical malpractice case must prove the following in order to establish fault. If these elements cannot be demonstrated, the case will not be successful:

The Doctor-Patient Relationship

In simple terms, this means that a doctor agreed to provide a patient with a diagnosis and treatment. This is the simplest matter to prove.

Substandard Medical Care

Next, it must be shown that the doctor did not meet the medical standard of care. Failure to provide competent care is a sign of medical malpractice.

The Negligence Caused Harm

Medical malpractice lawyers must show a link between substandard care and harm to the patient, such as injury or worsening of a condition.

Evidence of Hardships and Losses

It's also important to provide proof of harm. This includes medical bills for subsequent treatment, evidence of an impact on wages, and relevant documents.

Ophthalmology Malpractice

The lawyers at Zucker & Regev, P.C., have handled medical malpractice cases involving retinopathy of prematurity, diabetic retinopathy, LASIK or LASEK, retinoblastoma, and other eye-related conditions and treatments. Properly diagnosing and treating eye conditions is crucial for saving a patient's vision. If ophthalmologists fail to meet established standards of care, they can be held accountable through a medical malpractice lawsuit.
