The Benefits of Hiring an Erb's Palsy Attorney

Hold Negligent Doctors Accountable

Doctors are trained in how to safely deliver a baby without causing a birth injury. If your child was injured during birth, it was almost certainly preventable, and your doctor or the hospital should be held accountable so that they don't cause more damage during future births.

Recover Just Compensation

Victims of medical malpractice are potentially entitled to compensation for medical expenses, lost wages, emotional trauma, and more. Enlisting the help of a birth injury attorney can maximize your chances of receiving the largest settlement possible.

Enable Your Baby's Recovery

In all but the most severe cases, this form of palsy is a treatable condition. However, finding the best pediatric care in New York can be expensive. Our lawyers will fight for you to receive every penny you are owed so you can invest in the best available care for your baby.

An Introduction to Erb's Palsy

What Is Erb's Palsy?

Erb's palsy is a condition almost always associated with birth injuries that affects about two out of every 1,000 newborn babies. It occurs when the brachial plexus is injured during birth.

The brachial plexus is a network of spinal nerve roots that runs from the neck through the collar bone and armpit. These nerves are responsible for enabling movement and sensation in the hand, arm, and shoulder. When the brachial plexus is stretched, ruptured, completely torn, or is overwhelmed with scar tissue, it results in full or partial paralysis of the area. When the muscles from the shoulder to the elbow are affected, the condition is referred to as “Erb’s palsy.”

One of the most common causes of brachial plexus injury is shoulder dystocia. Shoulder dystocia refers to a complication during labor in which the baby’s shoulders are unable to pass under the mother’s pelvis. Doctors should be trained in how to address shoulder dystocia safely. However, some doctors handle the complication negligently or erroneously, resulting in a brachial plexus injury and, potentially, this form of palsy.

With consistent physical therapy and medical assistance, the damage done to the brachial plexus is resolved in 90 percent of cases. However, 10 percent of affected children experience a lifelong struggle with the effects of this condition.

How to Prove Medical Malpractice after a Brachial Plexus Injury

The Erb's palsy lawyers at our Brooklyn office are highly skilled in building medical negligence cases; we know that there are a number of specific circumstances that can indicate whether a doctor failed to take proper medical action to prevent a birth injury. These circumstances include:

  • Failure to manage or diagnose diabetes during the pregnancy
  • Inappropriate use of fundal (abdominal) pressure during labor
  • Failure to monitor and control maternal weight gain
  • Failure to accurately assess the weight and size of the baby by the third trimester
  • Inappropriate use of forceps, vacuum extractors, or traction on the infant’s head and neck
  • Failure to give the mother the option of cesarean section when multiple risk factors are known
  • Delayed diagnosis and/or inappropriate treatment of shoulder dystocia

If any of these negligent behaviors occurred during the delivery of your baby, you may have a viable medical malpractice claim, and you should contact our Brooklyn Erb's palsy attorneys as soon as possible.

Treating Erb's Palsy

The good news about this form of palsy is that it is treatable in many situations, and physical function can often be improved with consistent, proper care. In fact, one of the most important goals of bringing a malpractice case is achieving compensation for the costly medical fees associated with intensive treatment. Our New York law firm has access to respected physical therapists and specialists who can provide the level of care your infant deserves.

Parents of babies with brachial plexus injuries may use compensation from a malpractice case to pay for:

Physical Therapy

In most cases of this kind of palsy, physical therapy is the preferred treatment method. Gently massaging the affected arm and performing some mild motion exercises can improve the function and strength of the muscles.

Injections

Some babies can benefit from BOTOX® injections. In the early months of development, BOTOX can help the nerves recover.

Surgery

Severe brachial plexus injuries require surgery to correct. For the best results, surgery should usually be completed before the child is six months old. Surgery may repair damaged nerves or remove excess scar tissue.

Will My Baby Fully Recover?

Fortunately, most babies afflicted with this form of palsy are able to fully recover and live normal, unaffected lives.

However, medical attention is required very early in their development for a full recovery to be achieved. Because the necessary care can be costly, it is important to hire a palsy attorney who can help you recover just compensation for your medical expenses.

In rare cases of extreme nerve damage, full recovery may not be possible, and victims may live their whole lives with noticeable symptoms and impaired motor function. In these tragic cases, victims can be awarded significant compensation for their hardship.
